the access of your data resulting from your use of the Service and
in connection with the administration of your participation in the
Insurance Provider's health care plan.
Furthermore, you hereby acknowledge and agree that Philips
shall be permitted to view any and all of your data ("End User
Data") for the sole purpose of complying with FDA regulations
and its obligations therein. In addition, Philips may, in its
discretion, extract from the End User Data information on an
aggregated and anonymous basis, including without limitation
your age, gender, and prescription protocols (the "De-Identifi ed
Information") from which identifi ers have been removed
pursuant to 45 C.F.R. § 164.514 (together with any other relevant
statutes or regulations, as amended from time to time), such
that the De-Identifi ed Information is not Protected Health
Information ("PHI") and is not subject to the privacy restrictions
of HIPAA and any and all related privacy regulations. Without
limiting Philips's obligation to preserve the confi dentiality of
your PHI, Philips may use your De-Identifi ed Information for
statistical, analytical, and any academic or commercial purposes
on an aggregated basis. Philips shall not use or disclose the De-
Identifi ed Information in any manner inconsistent with HIPAA or
any other statute or regulation.
You hereby agree and acknowledge that your testing data and
blood glucose readings ("Testing Data") will not be automatically
sent to or monitored by your physician, medical advisor or any
health personnel that you seek or receive health services from
in connection with your health management needs (collectively,
"Health Agents"). Accordingly, you hereby waive and release any
such Health Agents and any respective affi liates from any and all
liability, damages, losses, actions, costs, and claims in connection
with the access of your Testing Data resulting from your use of
the Service.
Posting and Use of Content in the Member Area
The Member Area includes community areas, such as forums and
member areas, where members may post messages, images, and
other content. If you are a member, you (or the author) owns the
copyright in the messages, images, and other content you post
in the Member Area, but by posting such content to the Member
