6 – Technical provisions
The characteristics of the Pergola Product comply with applicable legislation and technical regulations in Italy, available on
request. Purchaser therefore assumes all risks and all and any liability relating thereto, holding harmless Pergola for any difference
between Italian regulations and those of the country of destination of the Products. Alternatively, Purchaser may notify the laws
and technical regulations in force in the country of destination and Pergola will assume the risk of conformity of the Products.
Pergola warrants the performance of the Products only and exclusively with regard to the uses, purposes, applications, tolerances,
capacities, etc. specifically indicated thereby, with the sole restriction of uses, purposes and applications that, according to
common knowledge acquired by ordinary users, are clearly and unmistakably ascribable to the Products.
Purchaser is not authorised to dispose of the Products furnished thereto by Pergola in a manner not complying with the
indications set forth in the previous subparagraph and in the instructions sheet (if any).
In the case in which Purchaser resells the Products, it shall inform its purchasers of these indications.
7 – Damage and injuries
Pergola will indemnify and hold harmless Purchaser from and against any claim, request, loss, liability asserted by third parties
relating to personal injuries and material damage incurred as a consequence of a faulty Product. In such case, Pergola shall be
liable only within the limits, terms and conditions of its Product insurance policy (a copy of the current policy is available on
request).
In the case of potential damage to third parties arising from a faulty Product, the parties shall cooperate in good faith to
determine the nature and extent of the measures to the adopted, including any recall of the Product. Recall costs and expenses
and those relating to other measures will be paid by Pergola within the limits, terms and conditions specified in its insurance
policy, excluding expenses relating to Product traceability which shall be paid by Purchaser.
