Section (1):
In the event of a defect of the unit, the Purchaser is entitled, at his option, to demand either subsequent correction or
replacement delivery (right of subsequent performance). If the subsequent performance fails or Lutron EA refuses subse-
quent performance or acceptance of subsequent performance cannot be expected from the Purchaser, the Purchaser is
entitled, at his option, to demand diminution of the price paid for the unit or to repudiate the contract.
Lutron EA will not be liable for damages or deficiencies due to abuse, misuse, inadequate wiring or insulation, or installa-
tion not in accordance with instructions accompanying the unit or other improper installation. Lutron EA will not be liable
for inoperability resulting from interference, incorrect installation, or environmental factors.
Section (2):
To the extent Lutron EA is liable for damages due to fault (intent or negligence) irrespective of the legal basis for this lia-
bility, the following restrictions apply:
(a) in so far as the buyer raises a claim which is based on intent or gross negligence of Lutron EA, its legal representa-
tives or its agents, Lutron EA is liable according to the statutory provisions.
To the extent the claim is not based on intent or gross negligence, Lutron EA is liable for damages only to the
extent to which the damage was foreseeable and typical to occur.
(b) in so far as Lutron EA, its legal representatives or its agents violate a substantial contractual obligation, Lutron EA is
liable according to the statutory provisions.
In this case the liability for damages is limited to the damage which was foreseeable and typical to occur.
(c) with regard to damages resulting from a violation of life, the body or health, Lutron EA is liable without limitation in
accordance with the statutory provisions.
(d) beyond this, Lutron EA is not liable for damages. This applies in particular to
damages which occur on items other than the sold item.
Section (3):
In case Lutron EA has guaranteed for the quality or durability of the unit, LutronEA is liable for damages without limitation
according to the statutory provisions. In this case, the
provisions in Sections (1) and (2) do not apply.
Section (4):
The mandatory provisions of the Act on Product Liability shall remain unaffected.
