Appendix D: Declaración de licencia de software
Ciertos componentes de software (mencionados aquí como "componentes de
fuentes abiertas") utilizados por el desfibrilador vestible LifeVest 4000 están
licenciados por ZOLL Medical Corporation (mencionada aquí como "ZOLL
Medical") bajo varios acuerdos de licencia de fuentes abiertas. Tal como lo
requieren las condiciones de estos acuerdos de licencia de código abierto, ZOLL
Medical ofrece proporcionar el código correspondiente a los componentes de
código abierto a petición, así como cualquier modificación de este código hecha
por ZOLL Medical.
NINGUNA GARANTÍA
EN LA MEDIDA EN QUE LA LEY APLICABLE LO PERMITA, LOS
COMPONENTES DE CÓDIGO ABIERTO SE PROPORCIONAN "TAL COMO
SON" SIN NINGUNA CLASE DE GARANTÍA, YA SEA EXPRESA O IMPLÍCITA,
INCLUYENDO, PERO NO LIMITÁNDOSE A LAS GARANTÍAS IMPLÍCITAS DE
COMERCIABILIDAD E IDONEIDAD PARA UN PROPÓSITO PARTICULAR O
CUALQUIER GARANTÍA CONTRA INFRACCIÓN O CUALQUIER VIOLACIÓN
DE LOS DERECHOS DE PROPIEDAD INTELECTUAL QUE CUBRAN LOS
COMPONENTES DE CÓDIGO ABIERTO. EN NINGÚN CASO, A MENOS QUE
LO REQUIERA LA LEY APLICABLE, NINGUNA DE LAS PARTES,
INCLUYENDO A ZOLL MEDICAL, SERÁ RESPONSABLE POR DAÑOS,
INCLUYENDO CUALQUIER DAÑO GENERAL, ESPECIAL, INCIDENTAL O
CONSECUENTE RESULTANTE DEL USO O DE LA INCAPACIDAD DE USO
DE LOS COMPONENTES DE CÓDIGO ABIERTO (INCLUYENDO, PERO NO
LIMITÁNDOSE A LA PÉRDIDA DE DATOS O A DATOS PROPORCIONADOS
DE MANERA INCORRECTA O A PÉRDIDAS SUFRIDAS POR CUALQUIER
PARTE DEBIDO A LA INCAPACIDAD DE LOS COMPONENTES DE CÓDIGO
ABIERTO DE FUNCIONAR CON CUALQUIER OTRO PROGRAMA).
